What is the SEND Provision Capital Grant – Plan of Intent?

In March 2017 the Government announced a £215 million commitment of capital funding (special provision fund) to support local authorities (LAs) to make capital investments in provision for pupils with special educational needs and disabilities.

Local authorities can use the funding to invest in new places and improvements to facilities for pupils with education, health and care (EHC) plans in mainstream and special schools, nurseries, colleges and other provision. The capital funding can be used for buildings, for example:

  • building a specialised classroom or
  • expanding existing buildings to create specialist provision.

How much funding is Hackney getting?

Since the initial allocation announced in 2017, two additional allocations have been announced (May 2018 and December 2018).

Hackney’s initial allocation from this fund is £662,722 each year for 2018-19 to 2020-21, a total of £1,988,167.

The first instalment of funding was received in summer 2018.

From the two additional allocations announced, Hackney have been allocated an additional £1,387,093 in funding. The current total allocation is now £3,375,260.

The additional allocations are expected to be paid to the LA in 2019-20 once the plan has been updated and published on the Local Offer.

Who will decide how the funding is used?

The Council consulted with the local community to complete a short plan showing how they plan to invest their funding. This plan was published on Hackney's Local Offer website and updates to this work are available below and in the download section of this page.

Hackney's SEND Provision project group

A project group was established in 2017 to lead on the development of recommendations proposing where to invest the special provision capital fund.

The project group consisted of representatives from:

  • Hackney Learning Trust
  • London Borough of Hackney
  • Hackney Independent Parents Forum (HiP)
  • Interlink, and
  • City and Hackney Clinical Commissioning Group.

SEND Provision survey and consultation

The Council ran a survey in June to July 2017 and a consultation during November 2017 to January 2018, both of which provided views of the community which have been considered in the development of the plan of intent.

What was decided after the consultation and project group involvement?

The SEND Provision Capital Grant - Plan of Intent

The SEND Provision Capital Grant Plan of Intent includes projects intended to be funded, wholly or partly, by the special provision capital fund by the Department of Education (DfE), but also other additional projects that fall within scope of the consultation but for which alternative routes of funding are potentially available.


The Council intend to use the special provision capital fund allocation for Hackney to fund:

  1. the development of specialist post 16 provision at The Garden for young people with ASD, and
  2. the development of an additional resourced provision at Queensbridge Primary School for primary aged children with ASD.

The Council have also included in the plan of intent two additional proposals for which alternative funding routes are available:

  1. A proposal for SEMH provision
  2. A proposal for expansion of an Orthodox Jewish independent special school.

These two proposals provide opportunity to increase and improve the provision available to children/young people with SEMH needs and those within the Orthodox Jewish community in Hackney.

The Council are continuing to explore these proposals with the schools.

The SEND capital grant plan is a plan of intent, is subject to change.

The plan will be reviewed and updated on an annual basis (or as required) and will form part of a wider provision planning process which will involve the local authority and the local area SEND Partnership Board.

March 2019 update...

The SEND Provision Capital Fund – Plan of Intent has been reviewed and updated. The cover report now includes an additional section providing an update of the progress of current proposals and provision planning.

The DfE template has been updated to the latest version with some updates to proposals. Financial allocations of capital funding to individual projects remain confidential and commercially sensitive whilst procurement for projects is in progress. This information will be added to the template once no longer commercially sensitive.

The Council intend to publish an update to the plan again in May 2019 to reflect intentions for additional capital funding allocated through the Special Provision Fund and any further consultation.

May 2019 update...

The SEND Provision Capital Fund – Plan of Intent has been reviewed and updated.

The cover report now includes an additional section providing an update of the progress of current proposals and provision planning in section 6.1.

The Department for Education template has been updated to the latest version with updates to the proposals and can be found below and in the download section of this page. 

The Council intend to publish a further update to the Plan of Intent in the Autumn of 2019.
